Right to schedule vacation - ECs

CAPE has been informed that some EC members are experiencing challenges in scheduling their accrued leave credits. CAPE would like to take this opportunity to remind you of your right under the collective agreement to schedule vacation leave. It is to be noted that the language in the collective agreement does not provide any limit on the amount of leave that can be requested, nor how far in advance it can be scheduled.

Entitlement to vacation leave with pay

24.03 An employee is entitled to vacation leave with pay to the extent of the employee’s earned credits. An employee who has completed six (6) months of continuous service may receive an advance of credits equivalent to the anticipated credits for the vacation year.

Scheduling of vacation leave with pay

24.04 The Employer reserves the right to schedule an employee’s accumulated earned but unused vacation leave credits but shall make a reasonable effort:

a. to grant an employee’s vacation leave in an amount and at such time as the employee may request;
b. to ensure that approval of an employee’s request for vacation leave is not unreasonably denied;
c. to schedule vacation leave on an equitable basis and when there is no conflict with the interests of the Employer or the other employees, according to the wishes of the employee.


For those of you who have accumulated leave credits over the period of the moratorium on the mandatory cash of leave credits, beginning March 31, 2022, a portion of this leave will be subject to be cashed out. If you do not wish to have some of this leave cashed out, it is important that you schedule your leave prior to March 31, 2022. A reminder that you will also need to schedule all of your leave credits for this vacation year (i.e. April 1, 2022, to March 2023), as well as all excess leave credits accumulated during last vacation year (i.e. from April 1, 2021, to March 31, 2022) prior to being able to schedule any leave accumulated during the moratorium. The reason for this is that the employer’s IT system only uses carried-over credits after the current year's leave credits have been scheduled.
