Ottawa, ON K1A 0A6Dear (Member of Parliament):On February 26, 2007, the Ontario Superior Court of Justice will resume hearings on the federal public service pension surplus litigation. You may recall that following passage of Bill C-78, the Public Sector Pension Investment Board Act, in 1999, the federal government took $30.2 billion from the surplus to apply it towards the debt. Close to 50% of this money actually came directly from my and other plan members' contributions through deductions on our paycheques. Federal unions and pensioners’ associations have taken legal action to have this money put back into the superannuation accounts.Bill C-78 represents a fundamental breach of the government’s fiduciary obligations towards current and retired members of the pension plans. I am sure the Courts will rule in our favour. At this juncture, it is not too late for the government to intervene and spare Canadian taxpayers any further expense and acrimony of long and protracted legal proceedings.
