Pension Appeal to Proceed

The Supreme Court of Canada has granted CAPE, PIPSC, PSAC and several other public service bargaining agents and representative organizations our applications for leave to appeal the 2010 Ontario Court of Appeal decision.
In October 2010 the Ontario Court of Appeal dismissed the case against the federal government.“We are extremely pleased with the Supreme Court’s decision,”
said CAPE President Claude Poirier. “This case has its origins in Bill C-78, passed in 1999. C-78 gave the federal government the legal right to misappropriate an almost 30 billion dollar pension surplus fund."
