TR Bargaining Update

On Tuesday, January 10, 2012, in order to resolve the impasse at the TR bargaining table, CAPE made a request to the Public Service Labour Relations Board for the establishment of an arbitration board. In accordance with the Public Service Labour Relations Board Regulations, CAPE submitted a description of the negotiations to date, a list of CAPE’s proposals that remain in dispute, and the full wording of those proposals. The Treasury Board has been notified of CAPE’s request. The PSLRB will in turn be contacting the Treasury Board to ask it to supply its own list of proposals in dispute and any other information that may be required. CAPE has asked the PSLRB to establish a three-person arbitration board. If the PSLRB agrees to establish an arbitration board, that is, if it is satisfied that CAPE, the party making the request in this case, has bargained sufficiently and seriously with respect to the matters in dispute, it will ask each of the parties to name a representative to sit on the arbitration board. The two representatives will then by common agreement name an individual to be the third member and chairperson of the arbitration board. If the two representatives are unable to come to an agreement on the choice of a chairperson within the prescribed time limit of five days, the Chairperson of the PSLRB will appoint someone he considers suitable to chair the arbitration board. Once the arbitration board has been duly established, it must schedule the dates of hearings. Given the various steps that must be taken before hearing dates can be determined, we anticipate that these dates will not be known until late January or thereabouts.
