CAPE received notice from the Public Service Labour Relations Board (PSLRB) on January 17 that the Board is proceeding with the establishment of a three-member arbitration board further to a request from CAPE.

CAPE filed for arbitration on December 14. As required it provided the Public Service Labour Relations Board (PSLRB) a list of outstanding issues brought to the table by CAPE, the language of the proposals, and a description of bargaining that occurred during the current round.

Negotiations have been difficult, yet some important issues have been resolved and the parties have conditional agreement on several proposals. If there is agreement at the bargaining table, the improvements to the collective agreement will be included in the tentative agreement.

After the exchange of proposals in late August, the parties reconvened at the bargaining table on October 4-6 and 18-20. Things were progressing smoothly and we were cautiously optimistic that a settlement would be reached at the table.

CAPE exchanged collective bargaining proposals with the Employer at the Library of Parliament on August 30th. The parties will reconvene at the bargaining table on October 4th, 5th and 6th and on October18th, 19th and 20th.

The Invitation to Bargain Early and a Call for Membership Input

In an article posted on its web site on October 15 CAPE announced that it had accepted an invitation from Treasury Board to meet at the bargaining table prior to the expiration of the TR collective agreement and prior to the expiration of the EC collective agreement. These meetings will occur in the wake of a recent tentative settlement between the Public Service Alliance of Canada (PSAC) and Treasury Board at 3 of the 5 PSAC tables and a rejection to meet by the 6 bargaining teams of the Professional Institute of the Public Service of Canada (PIPSC). CAPE has prepared a Questions and Answers document on recent events and on the process ahead. The Qs & As also contains a call for input from members and e-mail addresses to which the input should be sent. Members should note that the invitation was from Treasury Board. As a result, the newly appointed bargaining committee for our members at the Library of Parliament will be preparing for negotiations according to the normal and expected calendar.

When bargaining becomes an issue

CAPE is the bargaining agent for two Treasury Board groups, the EC and TR groups, and one group at the Library of Parliament, and the three collective agreements for these will be up for renewal in 2011. As usual, CAPE has made a call for volunteers to form bargaining committees to negotiate those three contracts when they expire next year.

However, even before these committees could meet in order to begin the long process of preparing for the bargaining table, we saw in the media that the Treasury Board Secretariat was inviting the Public Service Alliance of Canada to what was called "expedited" bargaining. The Alliance was the only union involved in this at the time. Those bargaining agents who were either already at the table in the regular cycle, including the Professional Institute of the Public Service of Canada for some of its Treasury Board groups, or bargaining agents that had sent their notice of intention to bargain, were side-tracked by Treasury Board to allow this.
