Filing a Classification Grievance for the EC Conversion

June 17, 2009

Members should first try to work issues out with their supervisors, as per the informal review process outlined in Treasury Board’s classification grievance procedure. However, it is possible that in many cases, members will continue to have concerns. It is anticipated that there will be many EC members of CAPE who will seriously consider the possibility of filing a classification grievance in response to the Official Personal Notification (OPN) that they are expected to receive in the week of June 15. CAPE’s office will probably be receiving many calls and e-mails in the weeks following the OPN week.

Where a grievance is being considered as a real possibility, members should protect their right to grieve by filing a grievance within 35 calendar days following the date that they receive their OPN. In order to ensure that members can protect their right to grieve, CAPE is providing wording for such a grievance. Members who wish to file should get a grievance form from their supervisor, a labour relations specialist or a human resources specialist within their department or at:
http://www.tbs-sct.gc.ca/tbsf-fsct/dwnld/340-55.pdf.

Members can always withdraw a grievance at a later date.

Remember: the grievance must be filed within 35 calendar days (including Saturdays, Sundays and Holidays) of receiving the OPN.
