Subject: The FIP Collective Bargaining Committee
Pursuant to the provisions of Paragraph B 7.1.1 (i) of By-law # 7, and on behalf of the National Executive Committee, this constitutes a call for volunteers from the membership of the TR bargaining unit for the purpose of establishing a Financial Incentive Plan (FIP) Collective Bargaining Committee. In accordance with the provisions of the By-law, the call for volunteers must be made no later than 6 months prior to the expiry date of the agreement (FIP). It must be made no later than September 30, 2007.
Volunteers must submit their reasons for wanting to be a member of the committee as per the provisions of Paragraph B 7.1.1 (iii) of the By-law. The names of the members who volunteer to serve on the Collective Bargaining Committee will be presented to the National Executive Committee (NEC) for approval, as stipulated by Article 13.2 of CAPE's Constitution. The NEC will choose the members of the Collective Bargaining Committee according to the criteria identified in Paragraph B 7.1.2 of the By-Laws.
The names will be presented to the NEC at the meeting scheduled for the end of October. The procedures of the NEC require that all documentation pertaining to a meeting be translated and provided to members of the Committee a week prior to the meeting. Therefore the national office must receive the names of volunteers as well as their reasons for wanting to serve on the committee no later than noon, Friday October 12, 2007. I invite the TR local leaders to share information regarding the FIP Collective Bargaining Committee with the TR members that they represent. The memorandum that you are reading will also be posted on the CAPE web site.
I remind you that the responsibility of negotiator belongs to the President of the Association, José Aggrey (Constitution, Paragraph 9.2). The President may delegate the responsibility to a Vice-President, to a member of the National Executive Committee or to a member of the Association's management (Constitution, Paragraph 9.12).
