The Canadian Human Rights Commission Approves the Settlement Reached in CAPE’s TR complaint!

The Canadian Human Rights Commission (CHRC) advised the Canadian Human Rights Tribunal (CHRT) that they have approved the agreement reached as a result of CAPE’s complaint on behalf of TRs.
The complaint filed by CAPE with the Canadian Human Rights Commission, on behalf of TRs, has been settled by mediation through the Canadian Human Rights Tribunal!

The representatives of both the employer (Treasury Board and Translation Bureau) and CAPE have settled out of court the complaint filed by CAPE. This settlement came during a mediation session held on March 27 by a mediator appointed by the Canadian Human Rights Tribunal.

CAPE’s TR Canadian Human Rights Commission Complaint Moves Forward!

On October 28, 2008, CAPE received confirmation from the Canadian Human Rights Commission that it will ask the Chairperson of the Human Rights Tribunal to designate a member of the Commission to institute an inquiry into the complaint.

In April and May there was a feeling with CAPE’s TR bargaining team that tentative progress was being made. However, CAPE was very disappointed at the June meetings when some of the outstanding issue which it saw as very important and for which there was some apparent openness on the employer’s side where for all intents and purposes left unaddressed.

Bargaining resumed on March 18th and 19th. The March 20th day of bargaining was cancelled. Discussion centered on two problems.

CAPE and Treasury Board have agreed to continue the Financial Incentive Plan for 2008-2009 and 2009-2010 in the Professional Services sector, with a few changes. The employer has decided to abolish the FIP in the IPTD.

CAPE’s TR bargaining team met with representatives of the employer’s bargaining team on August 15 and August 16. Because the employer and CAPE have agreed again in this round to use interest based bargaining at the TR table the parties did not exchange proposals.

In September, the Association sent out a call for volunteers to sit on the TR Collective Bargaining Committee, and the TR Negotiating Committee for the Financial Incentives Plan. The National Executive Committee approved the members of both bargaining committees on October 11, 2006.

The Canadian Association of Professional Employees’ (CAPE) TR Group has concluded an agreement in principle aimed at renewing the TR collective agreement. The TR Group includes 1,100 Translators, Interpreters and Terminologists of the Federal Public Service.
TR Collective Bargaining Negotiations – An Update

The negotiating teams for CAPE and the employer met at the beginning of May, following a lengthy hiatus as a result of the dissolution of Parliament in November. The teams discussed issues that had not yet been addressed at the table. Progress has been made and it appears that negotiations are coming to an end.

Update on TR Collective Bargaining

When negotiations for the TR collective agreement were suspended last December due to the federal election, a number of important issues had not yet been addressed at the Table. Treasury Board has remained in regular contact with CAPE and we will be advised as soon as Treasury Board is prepared to resume bargaining.
The Translation Bureau Move – It’s NOT going to happen

During the months leading up to the election, CAPE campaigned vigorously against the suggested move, meeting with Public Works and Government Services Officials, and Translation Bureau management, with the goal of seeking a commitment to leave the Translation Bureau intact and in place.

CAPE, the Local and the Translation Bureau have reached an agreement establishing a framework for union-management consultation. We trust the outcome of all this effort will be better ways of consulting the union within the Bureau. To that end, training for managers and union stewards will be provided early in 2006.

In contrast to the information some managers seem to be purveying, CAPE did not and still does not require that the Bureau distribute deadline performance reports to employees, unless requested to do so.
The Standby Issue – Translation Bureau

You will doubtless recall that last winter, in connection with the after-hours service, the Translation Bureau set up a pilot project for 24/7 service that included the practice of calling translators back to work without placing them on standby, which limited the cost in overtime and standby pay.

The CAPE team responsible for negotiating the TR Collective Agreement met with the employer's negotiating team on Tuesday and Wednesday, June 14 and 15. These meetings followed several months of work during which the TR Collective Bargaining Committee completed the preparation of problems which may be solved by modifications to the collective agreement.

Rumours have circulated and have been reported in the news of an imminent move of 400 translators from the National Capital Region to New Brunswick. CAPE has received assurances from the Translation Bureau that no move is being planned or explored at this time.

As you are aware, management at the Translation Bureau announced, in April, its decision to substantially increase the production objectives of its employees.

It is understood that the right to impose these production objectives carries with it the requirement to explain and justify these objectives and to foster good work. As well, the established objectives must be attainable, and may be the subject of a challenge – notably in relation to the particular billing and production conditions that exist in certain areas.

We received 930 ballots (87% return rate); no ballots were rejected and 39 ballots were spoiled. 891 members (99.88%) voted in favour of accepting the tentative agreement, 1 member(0.12%) voted against.
