EC Conversion – the Treasury Board refuses mediation in the matter of CAPE’s policy grievance alleging violation of article 27.07 (refusal to negotiate)

When CAPE filed the notice of reference to adjudication of its policy grievance, the Association informed the Public Service Labour Relations Board (PSLRB) that it was prepared to participate in a mediation process to attempt to settle the grievance.

The hearing of the policy grievance that was filed by CAPE on July 14 was held on September 14. In a reply rendered on October 6, Ms. Hélène Laurendeau, Assistant Deputy Minister, Treasury Board, denied the grievance. The employer is of the opinion that it has met its obligations under article 27.07.

The EC bargaining team has advised Treasury Board officials that it agrees to the employer’s final offer. The final offer covers 4 years. It includes pay adjustments of 2.3% retroactive to June 22 2007, 1.5% retroactive to June 22 2008, 1.5% effective June 22 2009 and a final 1.5% as of June 2010. EC classification conversion receives no extra monies.

DISPUTE RESOLUTION - ARBITRATION

The decision to choose arbitration rather than the alternate, conciliation/strike, is done by the Association prior to each new round of collective bargaining. CAPE EC members voted before this round of negotiations on which of the two dispute resolution methods they prefer should an impasse be reached. Association Ratifies New SI/ES Collective Agreement

On June 27th the Association signed a new SI/ES Collective Agreement with Treasury Board. The agreement was ratified by an overwhelming majority of the voting members.

The Association and Treasury Board have signed a three year tentative agreement for the Social Science Support Group (SI) and the Economics, Sociology and Statistics Group (ES).

The agreement, if ratified by the membership, will come into effect retroactive to June 22, 2000, and follows months of complicated negotiations.

ES SI Collective Bargaining Update: Wage Harmonization

Treasury Board and the Association agreed to start addressing immediately pay issues arising out of the fusion of the ES and SI groups. The resulting wage harmonization establishes a single set of pay ranges for SIs and ESs, completed and effective June 21, 2001.

Collective Agreements for the Association's members in the ES and SI groups expired on June 22, 1999. Prior to this date, by a majority of 99%, the Association's membership approved the use of binding arbitration to resolve any disputes with the federal government employer.
