Marriage Leave in the EC Collective Agreement vs. 5 days leave granted to members of other Bargaining Agents

When the EC’s went to the bargaining table, they were offered three days, once in a career, in exchange for marriage leave. The EC Negotiation Team’s position was to extend marriage leave to same-sex couples.
Extra Increment for Some Promotions to ES-03/SI-04

The Canadian Association of Professional Employees and Treasury Board signed a Memorandum of Agreement on February 23rd, 2004, which makes the arbitral decision regarding promotions from the ES-02/SI-02 pay line to the ES-03/SI-04 pay line effective June 22, 2003.
Pay Increases and New Entitlements

The new EC Collective Agreement will be signed on November 29, 2004. In response to questions regarding the period during which the employer must implement the pay provisions, please note that the pay adjustments must be implemented within 90 days of the arbitral decision (October 14, 2004), not within 150 days.

Update on EC Arbitration

While Treasury Board increases tensions across the labour relations horizon in the federal public service, CAPE prepares for arbitration. The Association and the Treasury Board exchanged arbitration briefs on Tuesday September 21. The parties will review each others brief, and prepare rebuttal arguments prior to the arbitration hearings which take place next week on September 27, 28 and 29.

One of the Employer's key proposal at the bargaining table was to express all leave provisions in the collective agreement in hours, with one day being equal to 7.5 hours.
CAPE is proceeding to arbitration on behalf of the EC Group

CAPE has just received confirmation from the Public Service Staff Relations Board (PSSRB) that an Arbitration Board will be established for the arbitration of the matters still in dispute between us and the Employer. We are referring 15 matters to arbitration.
Leave for Spousal Union – the EC Group

The problem we had with this proposal is how Treasury Board proposed to eliminate discrimination – 1) by taking away an entitlement from heterosexual EC members rather than extending it to all EC members in a non-discriminatory fashion and 2) by lowering the current entitlement of a group against which there is no discrimination.

To bargain or not to bargain

It is a difficult decision to withdraw from the negotiating table. Members of the negotiating team are well aware of their responsibility to bargain on behalf of the membership of the bargaining unit. The negotiating team invested considerable time in preparation for negotiations.
DISPUTE RESOLUTION - ARBITRATION

The decision to choose arbitration rather than the alternate, conciliation/strike, is done by the Association prior to each new round of collective bargaining. CAPE EC members voted before this round of negotiations on which of the two dispute resolution methods they prefer should an impasse be reached. Arbitration was chosen as the preferred route for this round.

After four frustrating days of negotiations over the last two weeks your EC bargaining team has concluded that Treasury Board negotiators are unable or unwilling to move any further toward reaching a new collective agreement. Collective Bargaining Delays - Little Impact on CAPE

CAPE has decided to postpone to February the EC collective bargaining sessions that were scheduled to resume in late January after learning that Treasury Board would not be in a position to discuss any proposal that has a monetary implication (including salaries and, for example, leaves).

At the meetings on September 30 and October 1 both Treasury Board and CAPE negotiators explained their proposals in some detail. This took some time as the EC Collective Bargaining Committee assembled a significant proposals package.
CAPE PROPOSALS ON BEHALF OF THE EC (ES AND SI) GROUP

Your union, CAPE, exchanged bargaining proposals with the Employer on September 26th, 2003, with the exception of monetary proposals. Traditionally the Employer will not discuss pay issues until the majority of non-monetary items are settled. We do not expect their approach to be any different this time. Therefore, our pay proposal is still being developed. Once our pay proposal is presented to the Employer, details will be posted on our website.

Association Ratifies New SI/ES Collective Agreement
June 2001
On June 27th the Association signed a new SI/ES Collective Agreement with Treasury Board. The agreement was ratified by an overwhelming majority of the voting members.
The Association and Treasury Board have signed a three year tentative agreement for the Social Science Support Group (SI) and the Economics, Sociology and Statistics Group (ES).

The agreement, if ratified by the membership, will come into effect retroactive to June 22, 2000, and follows months of complicated negotiations.
ES SI Collective Bargaining Update: Wage Harmonization

Treasury Board and the Association agreed to start addressing immediately pay issues arising out of the fusion of the ES and SI groups. The resulting wage harmonization establishes a single set of pay ranges for SIs and ESs, completed and effective June 21, 2001.

The SSEA Collective Bargaining Committee met with Treasury Board on April 23, in the hopes of furthering the collective bargaining process. Treasury Board responded in a positive manner presenting proposals that improved upon a previous offer of a 2% salary increase per year - an offer that we made clear was unacceptable.

Notice to bargain was given in the Spring. Initial meetings to map out an agenda did not allow for progress as the Department of Finance had yet to give Treasury Board a mandate for negotiations with the Association as late as the first week of July.
Collective Bargaining for ESs and SIs Scheduled for October
October 2000
Collective Agreements for the Association's members in the ES and SI groups expired on June 22, 1999. Prior to this date, by a majority of 99%, the Association's membership approved the use of binding arbitration to resolve any disputes with the federal government employer.
